The 1901 Militia Pensions Act contained a clause, known as the ‘golddigger clause’ that disallowed pensions to survivors of Veterans who married after the age of 60.
Spouses of Veterans and RCMP Veterans, including common-law partners, who marry after the age of 60 are not entitled to the automatic survivor pensions under the Canadians Forces Superannuation Act. This clause also applies to federal public servants and federal judges who marry after they retire.
The Liberals promised to eliminate the clause in 2015 and 2017, but reneged in 2019 and have since said they are studying the issue. That's not good enough.
In December of 2021, North Island-Powell River MP and NDP Critic for Veterans Rachel Blaney introduced a private Member's bill to eliminate the 'golddigger clause'.
The lifespan of Canadians is much longer now than in the early 20th century. We should not punish people for finding love after the age of 60 or after they retire. This pension clause is sexist and archaic and must be eliminated!
